Will You Have to Go to Court Over a Paternity Issue?
Court cases for establishing parental rights arise in a variety of circumstances:
- Where children are born during a marriage
- Where there is no marriage and the parents resided together
- Where parents married or attempted to marry after the birth of a child or children
- Where the parents never resided together
Why Isn’t Paternity Automatically Assumed When the Mother Says So?
Paternity is legally presumed in certain circumstances:
- When the child is born while the mother and her husband were cohabiting
- By a voluntary declaration of paternity
- By legal presumptions created by statute
- By an action for paternity
Are You Seeking a Genetic Test to Prove Paternity?
The court may order the mother, child, and alleged father to submit to genetic tests as long as the case is within a specific time after the birth.
